“เด็ก” คือใคร คำจำกัดความในทางกฎหมายของ “เด็ก” คือ ผู้เยาว์ หรือ คนที่อายุต่ำกว่า 18 ปี ยังไม่บรรลุนิติภาวะ และได้รับความคุ้มครองทางกฎหมาย ให้ได้รับการช่วยเหลือ มีสวัสดิภาพ สิทธิในด้านต่าง ๆ ภายใต้อนุสัญญาว่าด้วยสิทธิเด็ก โดยสิทธิที่เด็กจะได้รับต้องมีความเท่าเทียมและไม่ถูกละเมิด เด็ก และ เยาวชน ต่างกันอย่างไร? แม้ว่า “เด็ก” และ “เยาวชน” จะมีความหมายที่ใกล้เคียงกัน แต่สามารถให้คำจำกัดความออกมาได้ คือ เด็ก คือคนที่ต้องได้รับการดูแลอย่างใกล้ชิดจากผู้ปกครอง ส่วนเยาวชน คือ คนที่มีช่วงวัยอยู่ระหว่างเด็กและผู้ใหญ่ อาจต้องมีคนช่วยดูแล แต่ไม่ต้องใกล้ชิดเท่ากับเด็ก
